Many industry experts consider the Texas deregulation bill one of the best in the nation.The fact that a considerable amount of the large energyconsumers would be required to purchase energy motivated suppliers to gear up and compete fornew business or, perhaps, protect the business they would lose.Another key feature of the deregulation bill is the stipulation that no one company can own over20% of the generation assets in Texas. This foresight ensured there would be a minimum of fivegeneration companies in Texas.The deregulation bill also provided financial assistance for energy conservation and manycustomers have elected to pursue energy conservation projects in light of the financial assistanceavailable.In a separate matter, the State of Texas has passed Senate Bill 5. This bill is an air quality billthat requires the political subdivisions in 38 counties in Texas to establish a five year energyconservation program. The theory is that reduced energy consumption will reduce emissionsfrom coal fired power plants and improve the air quality in Texas.This paper provides an overview of the benefits of deregulation in Texas and the efforts of manycities and counties to establish energy conservation programs that are cost effective.
